Can I fly with CBD oil? That’s a question that comes to lots of people’s minds when it comes to traveling. The potential benefits of CBD to fight off jet lag, travel anxiety, or just as part of your daily ritual make it something you definitely want to pack, but can you?
In this post, we’re answering the question, “can you fly with CBD oil?” to get you up to speed on the current rules and regulations for traveling with CBD. Can I Travel With CBD Oil?
For people who love to travel, the past couple of years have been really tough. Even people who haven’t fully caught the travel bug just yet have probably found themselves daydreaming about packing up and going anywhere! Before you book that plane ticket and start jet setting around chasing sunsets though, you’ll want to get an answer to the question, “can I fly with CBD oil?”
At the time of this guide, determining, “can I travel with CBD oil?” is a complicated question. In the United States, CBD is legal at the federal level and has been since the Agriculture Improvement Act of 2018. That said, some states have been slower to adjust their rulings on CBD than others.
For example, South Dakota has had fluctuating rulings over the past two years defining whether or not CBD is legal in that state. Because states are having to reassess their approach to CBD products, you should always confirm the most recent laws before you start packing your favorite CBD tincture to take with you.
Can You Fly With CBD Oil?
Once you’ve figured out if you’re able to bring CBD into another state from where you’re traveling, the next question is can you fly with CBD oil? The TSA has its own set of strict guidelines when it comes to what people can check in their luggage or bring on the plane with them.
Some people choose to travel with CBD because it may help calm down nervous flyers. Others just keep it on them as a part of a daily CBD ritual. No matter why you’re thinking about flying with CBD, it makes sense that CBD users may want to use it to help cope with stress and bring a feeling of calm when facing some of the current (and new) anxieties of flying.
Even though CBD and marijuana are different, the current TSA CBD guidelines reference them together under its Medical Marijuana category. At the time of this publication, TSA rules say that hemp-derived or FDA-approved CBD oil is generally allowed on planes. They follow federal laws allowing CBD products with no more than 0.3% THC. This means you shouldn’t have any problems choosing between your different types of CBD products (full spectrum vs broad spectrum) for the trip.
Products like CBD oil and CBD cream are still subject to TSA rules on traveling with liquids (called the 3-1-1- rule), which means you need to follow those instructions before you bring anything with you on the plane. The TSA 3-1-1 liquids rule states that each passenger on an airplane is allowed one quart size bag of liquids, gels, or aerosols. Each product must also be in its own 3.4 ounce travel-size container (or smaller).
Note: If you have a CBD vape pen and/or cartridges, TSA rules state you can pack those in your carry-on but not put them in your checked baggage.
Major Tip for Flying With CBD Oil
So…can you fly with CBD oil? The answer is yes, as long as you’re following the TSA guidelines for traveling with liquids and you’ve researched current regulations for CBD products for the location you’re traveling to.
Of course, a TSA agent won’t be able to tell right away if a CBD product contains less than 0.3% THC. No on-site testing is done on the product, so there may be room for misidentification. If you’re bringing your CBD with you to possibly help with travel anxiety or a fear of flying, the last thing you need is to be worried about whether or not the TSA will recognize your CBD products are being carried legally.
While the TSA guidelines state they do not actively seek out marijuana or illegal drugs, that doesn’t guarantee you won’t encounter a situation where a TSA agent is unfamiliar with CBD products and considers them the same thing. To help avoid any issues at the airport, you may want to consider printing out the official lab tests for your CBD products provided by the company and bring them with you.
